Our conditions for schools
TINO MDT is the social service time program of TINO Educare, a social enterprise focused on applying the TINO method in education and healthcare.
The goal of TINO MDT is to contribute to society through its program (activities) for young people, based on the three MDT pillars:

TINO MDT achieves this through its (school) programs, the TINO Portal with additional training materials (from 2024), the photo strips, open climbing sessions, public (final) presentations and (final) publications, periodic coffee moments with participating storytellers (guest speakers), and the annual TINO MDT summer party. In addition, we gather input from young people through our TINO MDT Youth Panel, and we actively encourage (former) participants to grow into team members.
TINO Educare depends on collaborating funds and partners for its TINO MDT program. They support the objectives of TINO MDT and ensure that we can offer the program to young people. At least two months before the program for the school or institution begins, we make concrete agreements with the school, including the number of pupils/students who will participate, the start and end dates, use of spaces, and any (co-)financing required from the school for the number of programs we will carry out there. These agreements are made with the respective school and confirmed in writing (by email).
To achieve our objectives—set by the Ministry of Education, Culture and Science (OCW) for our TINO MDT program—it is essential that, once registered, the program is actually carried out at the school in question.
Before visiting the school with our trainers, we already incur costs, such as recruitment and training of trainers, making schedules, ordering materials, and providing information to schools and trainers.
It is possible to cancel free of charge within 14 days of receiving the official participation confirmation by email. After that, we assume the program will take place. If the school still wishes to cancel, cancellation fees will be charged.
These general terms and conditions also serve as recognition that the school is aware of the conditions and the definition of “registration.”

1. General
These general terms and conditions apply to participation in the TINO MDT program of TINO Educare.
By agreeing to these general terms and conditions, the school confirms its definitive participation in the school program.
The school signs the cooperation agreement at least 90 days before the program begins.
TINO Educare guarantees that the regular program and its required materials comply with the specifications stated in the offer.

2. General expectations (commitment, preparation and technology, communication)
On behalf of the school, you commit to working with TINO MDT to provide young people with the tools and stage to participate in our activities.
We mutually promise to carry out all parts of the regular program to the best of our ability to maximize the impact on young people.
We strive for clear, prompt communication in both directions.
We expect thorough, practical preparation. This includes sharing all necessary information for the preparatory briefing, setting up materials and rooms for the workshops, and ensuring that at least one teacher is present per 30 pupils/students during each workshop. This allows our trainers to focus on training the young people and maintaining the quality of the program.
TINO Educare also employs sports trainers during the program. TINO Educare ensures that they have the required expertise and, where necessary, the necessary certifications (e.g., for climbing). Trainers deployed in TINO MDT are subject to the same conditions described in this document.
If an activity takes place at an external location, transportation arrangements will be made in consultation with the school. The school is responsible for post-activity planning and decides whether pupils/students return to school together or travel independently (home).

3. Delivery
In line with the Distance Selling Act, TINO Educare will process registrations within 30 days. This means confirming participation and contacting the school by phone and/or email to schedule a start date.
If TINO Educare is unable to deliver the school program due to force majeure, the school will be notified and may cancel the registration in that case.

4. Liability
The school is aware that the activities organized on its behalf involve physical activity and certain risks. TINO Educare accepts no liability for any damage arising in connection with the execution of the program. The school indemnifies TINO Educare and its instructors against all liability, unless TINO Educare’s team members have failed to meet contractual and/or legal obligations and can be held responsible.
In that case, TINO Educare is only liable for direct damage caused by intent or gross negligence on its part. Direct damage refers solely to reasonable costs the school must incur to correct shortcomings by TINO Educare, prevent or limit such damage, and establish the cause and extent of such damage—with a maximum of EUR 500 per incident.
Any liability of TINO Educare for indirect damage, including but not limited to consequential damage, lost profits, and lost revenue, is expressly excluded.

5. Right of withdrawal
In accordance with the Distance Selling Act (Article 7:5 Dutch Civil Code), the school has the right to cancel the registration free of charge within 14 days of receiving the official participation confirmation by email. If cancellation is not communicated in writing within this period, participation in the program is definitive.

6. Cancellation & participant absence
If participation is canceled after the withdrawal period, an invoice for cancellation costs will be sent to the staff member who registered the school. This covers part of the costs already incurred and must be paid within 30 days to TINO Educare.
In the event of cancellation by the school, TINO Educare charges:
a. all development and preparation costs incurred up to the time of cancellation;
b. all execution costs of the assignment:
– 100% of costs if canceled within 24 hours before the activity starts;
– 50% of costs if canceled within 48 hours before the activity starts;
– 0% of costs if canceled more than 48 hours before the activity starts;
c. all costs of any booked accommodation charged according to the provider’s terms.
We assume the number of participating pupils/students agreed upon in advance with the school. Changes can be communicated up to 30 days before the start, with a minimum of 15 participants required. Changes within 30 days are subject to the above cancellation terms.
If the number falls below 15 participants, the program cannot be started, and cancellation terms apply.
We must comply with MDT subsidy requirements, meaning an attendance rate of 80% per participant. If a participant is absent for more than 20%, we cannot count them as a participant. If more than 10% of the group exceeds this absence threshold, the costs of those participants will be charged to the school.
Example: in a group of 30, up to 3 students may exceed 20% absence without cost. This also applies to early dropouts.
The costs are a contribution to expenses per participant:

€450 incl. VAT if a student drops out after fewer than 4 sessions or has more than 20% absence.

€250 incl. VAT if a student drops out after at least 4 sessions or has more than 20% absence.
These fees do not apply if pupils/students change schools or discontinue their studies before or during participation. In those cases, no costs are charged to the school.

7. Data management
If the school participates in the TINO MDT program, its data will be included in the TINO Educare school database. TINO Educare complies with the Personal Data Protection Act and will not share this information with third parties.
TINO Educare respects the privacy of clients and participants in the school program and ensures confidential handling of personal data.

8. Force majeure
TINO Educare is not liable if obligations cannot be fulfilled due to force majeure.
Force majeure includes any external cause or circumstance reasonably beyond its control: supplier delays or failures, internet outages, power failures, email disruptions, third-party technology failures or changes, transportation difficulties, strikes, government measures, supply delays, negligence of suppliers or manufacturers of TINO Educare or assistants, staff illness, defects in tools or means of transport.
In the case of force majeure, TINO Educare reserves the right to suspend obligations or terminate the agreement in whole or in part, or to amend it to allow performance. TINO Educare is never obliged to pay penalties or compensation.

9. Intellectual property rights
All intellectual property rights related to the TINO MDT program belong solely to TINO Educare.
The school and its pupils/students are not permitted, without written permission from TINO Educare, to share, reproduce, distribute, transmit, or incorporate any of its content into other documents or materials.

10. Other provisions
This Agreement is considered a complete representation of the arrangements between the Parties at the time of signing.
If any provision is void, voidable, invalid, or otherwise unenforceable, this does not affect the validity of the remaining provisions. The Parties will consult to establish a legally valid replacement provision that aligns as closely as possible with the intent of the original.
Additions or deviations from the Agreement are only valid if recorded in writing between the Parties.
This Agreement replaces all previous agreements between the Parties.
